TERMS & CONDITIONS

SECTION 1 – AGREEMENT TO TERMS
By applying for, joining, or participating in the Bomsquad, you confirm that you are 18 years of age or older and agree to these Bomsquad Membership Terms & Conditions in full.
Participation is voluntary. These Terms constitute the entire agreement between you and Bomboom, LLC (“Bomboom,” “we,” “us,” or “our”) regarding the Bomsquad program, except for the Bomboom Terms of Service and other written policies expressly incorporated by reference.
No verbal representation, social-media communication, direct message, email exchange, or other informal communication modifies or supersedes these Terms unless expressly confirmed in a written agreement authorized by Bomboom.
SECTION 2 – ELIGIBILITY AND PROGRAM PARTICIPATION
No purchase is required to apply for or participate in the Bomsquad.
Submission of an application does not guarantee acceptance. Membership is granted solely at Bomboom’s discretion. Bomboom may approve or decline an application for any lawful reason and is not obligated to disclose the reason for an application decision.
Bomsquad membership does not create a contract of employment, partnership, joint venture, agency relationship, franchise relationship, sponsorship, influencer agreement, endorsement agreement, or compensated arrangement of any kind.
Members do not have authority to make commitments, representations, warranties, or agreements on behalf of Bomboom.
Bomboom reserves the right to modify, suspend, restrict, or discontinue the Bomsquad program, or any individual member’s participation in it, at any time and for any lawful reason, with or without notice and without obligation or liability to the member.
SECTION 3 – PROGRAM BENEFITS AND AVAILABILITY
All Bomsquad benefits are promotional membership benefits. Benefits are subject to availability and may be modified, restricted, replaced, suspended, or withdrawn at any time.
Member Discount: The 15% Bomsquad discount applies to qualifying purchases made through bomboomsport.com and participating Bomboom team-store offerings. The discount requires an active member account or other approved verification and cannot be combined with another discount, promotion, reward, or offer unless Bomboom expressly states otherwise in writing.
VIP Gear Bundles: VIP Gear Bundles are limited to one bundle per eligible member per calendar year unless otherwise stated. The 2026 offering is valid through December 31, 2026. Bundle contents, eligible products, category availability, sizes, colors, and inventory are subject to change. All VIP Gear Bundle sales are final unless otherwise required by law. VIP Gear Bundle pricing cannot be combined with another offer, discount, reward, or promotion.
Sizing: Standard products may be offered in sizes XS through 3XL, depending on product availability. Custom sizing may be available at an additional cost. Fit may vary between products, fabrics, collections, and styles. Members are solely responsible for reviewing published size charts and product information before ordering. Bomboom is not responsible for a sizing selection made by a member.
Preorders and Custom Orders: Estimated production and fulfillment time for preorders or custom orders may be approximately 8 to 10 weeks unless otherwise stated. Any stated lead time is an estimate and not a guaranteed delivery date. Bomboom is not liable for inconvenience, losses, event deadlines, missed races, or unmet expectations resulting from production, customs, carrier, supply-chain, or shipping delays.
Offers and Discounts: No two offers, discounts, rewards, credits, gift cards, promotional codes, or membership benefits may be combined unless Bomboom expressly states otherwise in writing.
SECTION 4 – EXCHANGES AND PRODUCT FEEDBACK
Bomboom may offer free exchanges for qualifying fit-related issues as a Bomsquad member benefit. This benefit is intended to support legitimate fit evaluation, product testing, and constructive product feedback. It is not a satisfaction guarantee, warranty of fit, or unlimited return or exchange policy.
Bomboom reserves sole discretion to determine whether an exchange request qualifies for this benefit.
We may decline, limit, condition, suspend, or permanently revoke exchange privileges for any member, including when requests appear excessive, abusive, fraudulent, repetitive, inconsistent with the intent of the program, or otherwise unreasonable.
No refund, compensation, credit, replacement, or explanation is owed in connection with a decision to limit or revoke a discretionary program exchange benefit, except where otherwise required by law.
Participation in product feedback, gear testing, surveys, reviews, or evaluation programs does not entitle a member to replacement gear, upgraded products, early-release products, monetary compensation, product compensation, or any other benefit beyond what Bomboom expressly states in writing.
SECTION 5 – USER-GENERATED CONTENT AND SOCIAL MEDIA
Bomsquad members are encouraged, but never required, to post photographs, videos, race results, reviews, testimonials, or other content; tag Bomboom; or share their experience through social media.
Social-media activity connected with Bomsquad participation does not constitute a paid sponsorship, brand-ambassador agreement, influencer agreement, endorsement contract, employment relationship, or compensated arrangement.
No photograph, video, review, testimonial, race recap, post, story, reel, comment, or other content created by a Bomsquad member entitles the creator to monetary compensation, product compensation, royalties, or other remuneration except for a benefit expressly offered under these Terms or another written Bomboom promotion.
By directly submitting content to Bomboom, using a Bomboom submission form, tagging an official Bomboom account in content relating to Bomboom or the Bomsquad, or otherwise providing content for potential reposting, you grant Bomboom a non-exclusive, royalty-free, worldwide license to use, reproduce, display, share, repost, crop, resize, format, and repurpose that content for Bomboom marketing, community, editorial, and promotional purposes.
This license applies without additional compensation but remains subject to applicable law and any rights held by third parties.
A member who wishes to revoke permission for Bomboom’s future use of specific content may contact us and identify the content in question. Revocation applies prospectively and does not require Bomboom to recall printed material or remove content that was previously published, distributed, incorporated into completed materials, or shared by third parties.
Members are responsible for ensuring that content they submit or tag does not infringe another person’s copyright, trademark, privacy, publicity, contractual, or other rights.
SECTION 6 – BOOMDOLLARZ
A $20 Boomdollarz reward may be issued at Bomboom’s sole discretion after verification of official race results and a qualifying public social-media post tagging Bomboom, in accordance with the current Boomdollarz program requirements.
Bomboom may request additional information, screenshots, race-result links, photographs, social-media links, account verification, or other documentation to confirm eligibility. Decisions regarding qualification and verification are final.
Unless Bomboom expressly states otherwise, Boomdollarz: (a) have no cash value; (b) are non-transferable; (c) may not be sold, exchanged, or redeemed for cash; (d) expire 12 months after issuance; (e) may be limited to one reward per qualifying result or event; (f) cannot be combined with another offer, discount, gift card, promotional code, reward, or member benefit; and (g) may be subject to product, order-value, geographic, or account restrictions.
Bomboom may deny, revoke, cancel, or correct a Boomdollarz reward that was issued because of an error, duplicate submission, false information, manipulated result, ineligible event, fraudulent activity, or misuse of the program.
Bomboom reserves the right to modify, suspend, or discontinue the Boomdollarz program at any time.
SECTION 7 – MEMBER CONDUCT
Members agree to act respectfully and honestly in all Bomsquad spaces and interactions, including the private Facebook group, social-media channels, events, direct communications, product-feedback activities, and interactions with other members, customers, athletes, retailers, event personnel, and Bomboom representatives.
Prohibited conduct includes harassment, threats, abusive behavior, discrimination, dishonesty, fraud, impersonation, misuse of confidential information, unauthorized commercial solicitation, misuse of discounts or benefits, manipulation of race results, and conduct that Bomboom reasonably determines to be disruptive or inconsistent with the Bomsquad community.
Members may not share private member discount codes, account credentials, restricted links, private group content, or other member-only access with nonmembers.
SECTION 8 – SUSPENSION AND TERMINATION
Bomboom may immediately suspend, restrict, or terminate a membership without notice when we determine, in our sole discretion, that a member has: (a) violated these Terms or another applicable Bomboom policy; (b) misused program benefits; (c) provided false or misleading information; (d) engaged in abusive, threatening, dishonest, or disruptive conduct; (e) shared member-only benefits or access without authorization; (f) harmed or attempted to harm Bomboom, its community, its reputation, another member, or a third party; or (g) acted in a manner inconsistent with the intended purpose of the Bomsquad.
No refund, credit, replacement, compensation, or continuation of benefits is owed following suspension or termination, except where otherwise required by law.
Any unused discretionary rewards, discounts, exchange privileges, or program benefits may be canceled when membership ends.
SECTION 9 – DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
The Bomsquad program and all associated benefits are provided by Bomboom “as is” and “as available.”
To the fullest extent permitted by law, Bomboom makes no warranties, express or implied, regarding the program, its availability, its benefits, product availability, product fit, product quality, delivery timing, community participation, visibility, social-media reach, race performance, or any outcome associated with membership.
To the fullest extent permitted by law, Bomboom, LLC and its members, managers, officers, employees, agents, contractors, suppliers, and representatives shall not be liable for direct, indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to Bomsquad participation.
This limitation includes damages or losses associated with product fit or quality, delayed or lost shipments, unavailable inventory, production delays, changes to benefits, discontinuation of a promotion, suspension or removal from the program, social-media activity, reliance on informal representations, missed events, race performance, injury, lost opportunities, lost profits, or unmet expectations.
Your sole remedy for dissatisfaction with the Bomsquad program or a discretionary program benefit is to discontinue participation.
SECTION 10 – INTERNATIONAL MEMBERS
International members are welcome to participate, subject to applicable laws, shipping limitations, payment limitations, product availability, and program restrictions.
Unless otherwise expressly stated, international shipping costs are not included in bundle pricing, reward values, free-exchange benefits, discounts, or other offers. International shipping charges may be quoted separately before fulfillment.
The member is solely responsible for customs charges, import duties, taxes, brokerage fees, carrier charges, return shipping, exchange shipping, and other costs imposed by the destination country, carrier, customs authority, or third-party service.
Bomboom is not responsible for customs delays, import restrictions, seizures, rejected deliveries, address errors, unavailable delivery services, or other costs or delays outside Bomboom’s reasonable control.
SECTION 11 – NO WARRANTY OF EXPECTATIONS
Bomboom does not represent or guarantee that Bomsquad participation will meet a member’s personal, athletic, social, financial, professional, promotional, or product-related expectations.
Program descriptions appearing on our website, in emails, in application materials, through social media, or in other communications are provided for general informational and promotional purposes. They do not create warranties or binding commitments beyond benefits expressly stated in these Terms or another written offer issued by Bomboom.
SECTION 12 – CHANGES TO THE PROGRAM OR THESE TERMS
Bomboom may update these Terms or modify the Bomsquad program at any time.
Updated Terms will become effective when posted or on the effective date stated in the revised Terms. Continued participation after an update constitutes acceptance of the revised Terms.
When reasonably practicable, material changes may be communicated through email, the member website, a private member group, or another Bomsquad communication channel.
SECTION 13 – SEVERABILITY AND WAIVER
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed without affecting the remaining provisions.
Bomboom’s failure to enforce a provision or exercise a right does not waive that provision or right.
SECTION 14 – GOVERNING LAW AND VENUE
These Terms and Bomsquad participation are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Unless otherwise required by applicable law, any action or proceeding arising from or relating to the Bomsquad shall be brought exclusively in the state or federal courts located in or serving Charlotte County, Florida.
By participating in the Bomsquad, you consent to the personal jurisdiction and venue of those courts.
SECTION 15 – RELATIONSHIP TO OTHER BOMBOOM TERMS
These Bomsquad Membership Terms & Conditions supplement the general Bomboom Terms of Service, Privacy Policy, Refund and Exchange Policy, Shipping Policy, and other applicable written Bomboom policies.
If these Terms conflict with the general Terms of Service solely regarding the operation of the Bomsquad program, these Bomsquad Membership Terms & Conditions will control with respect to that program.
